FICCO is proud to announce that it is already compliant with Republic Act 10173, otherwise known as the Data Privacy Act of 2012. This law provides that it is “the policy of the state to protect the fundamental human right of privacy, of communication while ensuring flow of information to promote innovation and growth.” It also emphasizes the “inherent obligation to ensure that personal information and communications system in the government and in the private sector are secured and protected. R.A. 10173 further states that the collection of personal data “must be for a declared, specified, and legitimate purpose”. It also requires the consent of a person prior to the collection of personal data. When obstaining consent, the subject shall be informed about the extent and purpose of the “automated processing of his or her personal data for profiling, or processing for direct marketing, and data sharing.” Consent is further required for sharing information with affiliates or even mother companies.
